Accompanying your spouse to the USA on an H4 visa — the complete guide for Indian families

When one partner clears the H1B lottery, the family conversation immediately turns to the other one. Can I come, can I work, what about the kids, should I just take a tourist visa for now. The decisions made in these first few weeks determine whether the next three years are comfortable or constantly complicated, and a surprising number of Indian families get them wrong out of impatience.
H4 or B2? The Choice Families Get Wrong Out of Impatience
Start with the basic distinction, because it is the one people blur. H4 is a dependent status for the spouse and unmarried children under twenty-one of an H1B holder, and it allows you to live in the United States for as long as the principal holds valid H1B status. B2 is a visitor visa, granted for a temporary visit with an intention to return, usually with a stay measured in weeks or a few months. They are not interchangeable, and choosing B2 because it seemed faster has consequences.
What H4 Lets You Do That a Visitor Visa Does Not
Why the difference matters practically. On H4 you may live there, you may study, your children may enrol in school, you may hold a driving licence in most states and you may apply for an SSN if you obtain work authorisation. On B2 you are a visitor, extended study is not permitted, and repeatedly entering and staying for long periods as the spouse of a worker will eventually attract a hard conversation at the port of entry. We see families who took B2 to save four weeks and then spent a year untangling it.
Applying for H4 From India Needs No Separate Petition
The H4 application process, when you are in India, is straightforward. You do not need a separate petition. Your spouse's approved I-797 for the H1B covers your eligibility. You fill your own DS-160, pay the MRV fee of two hundred and five dollars for the petition-based category, book your OFC biometrics and consular appointment, and interview, ideally on the same day and at the same post as your spouse if they are also being stamped.
The Marriage Registration Certificate Indian Families Forget
Documents for the H4 case are about proving two things, the relationship and the principal's status. Carry your marriage certificate, and this is where Indian families hit their most common snag. A temple or church ceremony certificate is not enough by itself. You need the government-issued marriage registration certificate from the registrar. If you married years ago and never registered, register it now, because backdating is not possible and a delayed registration with an affidavit explaining the gap is far better than nothing.
Photographs, Invitation Cards and Joint Accounts
Alongside that, carry wedding photographs across different events, your wedding invitation card, joint bank account statements, joint property documents, and any insurance policy or passport where you are named as spouse. Consulates in India do see arranged sham marriages and they know the markers, so a couple with a registered marriage, photographs and joint financials is the easy case. Newly married couples should not be alarmed by this, just carry more of the relationship evidence.
Proving the H1B Holder's Status Is Live and Current
For the principal's status, carry a copy of the H1B holder's I-797 approval notice, their valid H1B visa or their DS-160 and appointment details if you are interviewing together, their recent US pay stubs, their employment verification letter and their W-2 forms. If your spouse is already in the US and you are applying alone from India, this set becomes even more important, along with a copy of their passport and visa pages. Ask your spouse to courier fresh pay stubs rather than sending photographs of them, because a crisp printed set looks like what it is, which is current proof that the petition is live.
H4 for Children: Birth Certificates, Biometrics and the Age 21 Cliff
Children are simpler than people fear. Unmarried children under twenty-one qualify for H4. Each child needs their own DS-160 and their own MRV fee, and you carry their original birth certificate showing both parents' names, their passport and their school records. Children under fourteen are generally exempt from the interview in India and often from the OFC visit, which means a parent can submit on their behalf, but verify the current rule for your post before you plan the day. Do not forget that a child who turns twenty-one ages out of H4, which needs planning if your child is nineteen or twenty now.
Can an H4 Spouse Work? The Honest Answer About the EAD
Now the question every H4 spouse asks. Can I work? Not on H4 alone. You may work only if you obtain an Employment Authorisation Document, the H4 EAD, and eligibility is restricted to spouses of H1B holders who have reached a specific stage in the green card process, broadly where an I-140 has been approved or where the H1B holder has been granted extensions beyond the six-year limit under the relevant provisions. If your spouse is newly on H1B with no I-140, you are not eligible yet, and no amount of paperwork changes that.
Filing the I-765, and Planning for Months Rather Than Weeks
When you do become eligible, the application is a Form I-765 filed with USCIS, not something the consulate handles. Processing times have varied a lot, and biometrics may be required. Plan for months, not weeks, and file the renewal well before expiry because a lapse means you must stop working. This is a real career consideration for qualified Indian professionals moving on H4, and it is better to face it before you resign your job in Bengaluru than after.
What You Can Legally Do on H4 Without an EAD
What you can do on H4 without an EAD is more than people think. You may study, including a full degree, and many H4 spouses do an MS or an MBA. You may volunteer for an organisation in a genuinely unpaid capacity. You may hold passive investments and be a passive shareholder. You may not be employed, you may not freelance for US clients, and you may not run an active business where you perform the work. The line is performing services for pay, not the location of your laptop.
What the H4 Interview Is Actually Like
For the interview itself, keep it simple. H4 interviews are usually short and often a formality when the paperwork is clean. Expect questions about when and where you married, what your spouse does, their employer, their salary, where you will live, and whether you intend to work. Answer the work question honestly, which is, not immediately, I understand I would need an EAD and we are not eligible yet. Consistency between the spouses' answers about dates, employer and city matters more than anything else.
One practical tip families always thank us for. Apply together, interview together, and carry one combined file with clearly separated sections rather than three loose folders. And when you receive the visas, check every foil for name spelling, date of birth and validity, especially for children whose names often get truncated. Fixing a printing error while you are still in India is a minor errand, discovering it at Hyderabad airport at two in the morning is not.
